Town Patrol cracking down on violator's
Just to give folks a headsup...Town Patrol is doing after curfew sweeps, to catch violator's of curfew and off limits area's. I joined Town Patrol this weekend for one of thier sweeps, and they would go up to house (the bargirls houses),and see if they could hear GI's voices...if they did, they would not on the door, and request entry. Now is this allowed??? My opinion...would be no! They have no jurisdiction inside private housing off base, but they do have control over military personnel. So if the military member is inside the house, and he is given a direct order to step outside the house...he will be detained by security forces. Now is this right??? why are security forces going out of their way to hook up other military members??? I'm a cop, but im asking myself these questions.....what happen to the one team one fight concept????

Ouch! Good question. We all probably know the answer. Entrapment is a word that comes to my mind, Mav.
From my experience, note that personal "Rights" as we interpret them, normally are thought of, in an American's mind, in the context of US law. We are in a foreign country, and US law may not be a factor. I'm not a lawyer, so just bear with me. In the old days, in order to cover all bases, the town patrol was accompanied with Korean National Police. "Individual legal rights" were pretty much non-existant. These days I suspect the Korean law version of individual rights, if indeed they exist, would prevail. Perhaps a person who can speak with authority will read this. My GUESS would be that if no one opened the door, no one would be apprehended, even if he were in violation of the UCMJ. |

That is a tough one. What exactly are the curfew rules? The general rule before was to not be on the street or bars during curfew hours unless you were on duty or on the way to work. If you were in a residence it was usually over looked. Seems like they are getting strict!

Here the answer to two questions. First...They can't go inside the house and if a US Service member is in teh house they don't have to leave. The patrol has no jurisdiction anywhere off base/post. That is why in Iteawon the MP's go with the KNP's. The MP's can't ask ANYONE for an ID off post, but the KNP's can. They can ask for an ID and if they pull out an Military ID then the MP's have jurisdiction.
Second. They can be in any private house they want. There are no rules about spending the night at someones house after curfew. They just can't be in a public place. aslong as they are on base/post or inside a hotel or apartment after curfew they are ok. |

Hey mavic88, so whats new? I finally got logged in here, from the other yahoo groups site. Is this place better? safer? Whats new in A town? Hope you didn't get into much trouble. It was rediculous what the base does, most of the time.

Oh yeah and the last time I pulled CP (2 weeks ago) they briefed us that we COULD ask for ID.

Mav's initial "Warning" Post is nearly 3 months old. Probably they figured out the legal aspects by now at Kunsan.
There will always been a few patrols that go wrong. Remember the Lt. about 2 years ago who thought he was the town sheriff, taking payoffs and favors until he got court martialed & discharged? |
