Soldier sentenced to two years in Yongsan rape case

What I have seen in the past are light sentences when the case is not so clear cut. For instance, if there is any hint that the lady is claiming rape because she simply regretted having sex or placed her self in a bad situation where she did not have the ability or will to say no. For example, if a guy and a girl are friends and go out for drinks on a Friday night. They both get drunk and then wake up in the same bed obviously having sex. Turns out she is married and doesn’t remember saying yes.
I don’t know what happened in this case, but I have seen in the past that rape cases are not simple. Rape is not always I guy behind a bush that jumps out and rapes a female jogger in Central Park. Most of the time the girl and guy are friends or co-workers and that complicates most cases.

Information presented above - Noted. Date rape, friends raping friends, and questions of consent complicated by boose have been a problem ever since women entered the regular army in 1974, (Prior to that we had the WAF, WAC).
In this case, if the facts are similiar to the information published in the Stars and Stripes I still say "where is the justice." This seems to be another case of a newly arrived military member being attacked. This has been a trend for the past 10 years - newly arrived females being taken advantage of. I hope proper authorities have taken note. I agree, sometimes the accuser is not telling the truth. In cases like that the accused should always find Not Guilty." No sentence should be "pro-rated" on whether the judge/jury believes only a part of the facts. Either if was rape or the accused walks. The problem arises with the pre-trial agreements. The second problem is with the skill level of military attorneys. Nil to none in many cases. If you compare the sentence with the guy at Camp Humphreys, I believe he got 8 years ( different judge) - it does not seem fair. |
